Gallery Govind may collaborate with third-party vendors to enhance user experience and services. The gallery shall not be held accountable for any actions or liabilities of these third-party vendors.

User Information:

User information provided during registration or purchase will be securely stored and not shared with third parties, except in cases mandated by law enforcement or government agencies.

Download and Usage:

Users are not authorized to download or use images, data, or information from the Gallery Govind website for purposes such as sale, display, reproduction, or publication.

Artwork Transactions:

All artwork deliveries will be completed only upon full receipt of payment. International deliveries may take 15 to 18 working days, and domestic deliveries may vary.

Shipping Charges and Logistics:

Shipping rates, packing charges, framing costs, insurance fees, and other additional charges will be borne by the buyer, exclusive of gallery fees.

Insurance and Claims:

Buyers are advised to insure artworks. Gallery Govind may assist but will not be liable for damage or loss during shipping. Artists can opt for insurance for consigned artworks, otherwise, the gallery is not responsible for unavoidable damage or loss.

Condition and Representation:

Artwork depiction on the website may vary slightly from the original. Gallery Govind strives to provide accurate representations of artworks on its website. However, due to variations in digital displays and the nature of artistic media, there may be slight differences in colour, texture, and scale between the depicted image and the actual artwork.

Representational frames on paintings are for illustration purposes only. The actual frame accompanying the purchased artwork may vary, based on availability and artistic preferences. Buyers are encouraged to contact Gallery Govind for precise information regarding framing and presentation.
 

Payment and Financial Terms:

1. Authorized Payment Modes: Gallery Govind accepts payments through various authorized modes, including wire transfer (international and domestic), demand draft (domestic), and UPI transfer. Buyers are responsible for any associated charges, fees, or processing costs incurred during the payment process.

2. Payment Confirmation: Upon confirming an artwork for purchase, buyers shall receive an invoice detailing the total cost, inclusive of the artwork price, applicable taxes, shipping charges, framing costs, insurance fees, and other relevant expenses. Payment should be made as per the invoice provided by Gallery Govind.

3. Timely Payment: Buyers are required to make full payment within the stipulated time frame specified in the invoice. Any delay in payment may result in the cancellation of the order. The buyer shall be responsible for all resultant consequences, including but not limited to any cancellation charges or losses incurred by Gallery Govind. all payments are non-refundable.

4. Bank Charges and Shortfalls: Buyers shall bear all bank charges, processing fees, or any other charges/fees related to the payment transaction. In cases where the payment received is less than the invoiced amount (due to bank charges or other factors), the buyer is obligated to remit the shortfall within 7 working days from the booking of the product.

5. Interest and Charges: Failure to make payment as per the expected due date shall incur an interest charge of 18% p.a. on the outstanding payment. Additionally, GST shall be applicable on the interest accrued.

6. GST on Art Sales: Any sale that takes place within India is subject to GST at 12% on the sale value. 

7. Cancellation Due to Non-Payment: In the event of non-payment within the stipulated time, Gallery Govind reserves the right to cancel the order without prior notice. A cancellation charge of 10% of the total cost shall be levied. Any payments made prior to cancellation shall be forfeited.

Cancellation and Refunds:

1. Cancellation by Buyer: If a buyer wishes to cancel an order after making the payment, a written cancellation request must be submitted to Gallery Govind. Depending on the stage of processing, cancellation charges of 10% may apply. Any expenses incurred by Gallery Govind prior to cancellation, such as packaging or framing costs, shall be borne by the buyer.

2. Refund Policy: Once an artwork purchase is confirmed and payment is made, refunds shall not be issued. Buyers are encouraged to thoroughly review their selections before finalizing a purchase.

3. Gallery Govind's Right to Cancel: Gallery Govind retains the right to cancel a sale without prior notice to the buyer. In such cases, Gallery Govind shall refund the full amount paid by the buyer. This action may be taken due to unforeseen circumstances, artwork unavailability, or any other reasons deemed appropriate by Gallery Govind.

4. Non-Availability of Artwork: In the unlikely event that an artwork is found to be unavailable or unsuitable for sale after the payment has been made, Gallery Govind shall promptly inform the buyer. The full payment shall be refunded to the buyer, and Gallery Govind shall not be held liable for any further claims or damages.

Authenticity and Documentation:

Artworks are sold with certificates of authenticity and supporting documentation. Gallery Govind guarantees authenticity and offers refunds in case of proven inauthenticity within one month of sale.

Artwork Collection and Storage:

Buyers must collect purchased artworks within 15 days. Storage charges will apply thereafter. Sellers and artists must collect consigned works within 7 days upon notification.

Dispute Resolution:

Gallery Govind's decisions are final in case of disputes. The terms and conditions are governed by Indian law, with jurisdiction in Delhi or Ghaziabad, UP, India.

Modifications:

Gallery Govind reserves the right to modify or delete any terms and conditions without prior notice.

Indemnity:

Gallery Govind, its owners, affiliates, and employees are indemnified from claims arising due to breaches of these terms or violations of law by clients.
